By accessing or using Dialio ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Dialio provides internet-based voice calling services that allow users to make outbound telephone calls to phone numbers worldwide. The Service is provided on a pay-as-you-go basis using prepaid credits.

3. User Accounts

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring all information provided is accurate and up-to-date

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy. You are solely responsible for the content and nature of all calls made through your account.

5. Prohibited Uses

You may NOT use the Service to:

  • Engage in any illegal activity, including fraud, scams, or harassment
  • Make threatening, abusive, or harassing calls
  • Impersonate any person or entity
  • Transmit malicious content or engage in phishing
  • Violate any applicable laws or regulations
  • Conduct telemarketing without proper authorization and compliance
  • Make calls that violate the rights of others
  • Use automated systems to make bulk calls without authorization

6. Payment and Credits

The Service operates on a prepaid credit system:

  • Credits must be purchased before making calls
  • All credit purchases are final and non-refundable except as required by law
  • Credits do not expire
  • Call rates vary by destination and are displayed before each call
  • We reserve the right to change pricing with reasonable notice

7. User Responsibility and Indemnification

You are solely responsible for all calls made through your account. You agree to indemnify, defend, and hold harmless Dialio, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Any content or communications made through your account
  • Any claim by a third party related to calls made from your account

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIALIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, technical issues, or factors beyond our control. Dialio is not intended for emergency calls.

10. Account Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if we believe you have violated these Terms or engaged in prohibited activities. Upon termination:

  • Your right to use the Service will cease immediately
  • We may retain call records as required by law
  • Any remaining credits may be forfeited if termination is due to violation of Terms

11. Cooperation with Authorities

We will cooperate with law enforcement and regulatory authorities as required by law. This may include providing call records, account information, and other data in response to valid legal requests.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through appropriate legal channels.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
